How To Identify The Symptoms Of Neck Injury

Often times we believe that injuries can only come about as the result of big incidents such as a car or sports accident. But, there are times when which injuries—especially in the more sensitive parts of your body such as your neck—can be caused by seemingly normal everyday activities. At times, we only discover our injury it become a serious one.

By then it will take more time to heal. You will be spending more money on medical bills. Good thing there are ways by which you can prevent the worsening of your neck injury. You can do this by paying attention to your body and identifying possible neck injury symptoms. And by reporting these to your doctor so he can recommend proper preventive measures.

Basically any kind of pain you feel in your neck is a symptom of a possibly serious. You may think that sleeping in the wrong position, straining your neck while watching a concert, or getting a stiff neck (for no apparent reason) are just normal occurrences. The pain will just go away after a few days, you may think.

See How Easily You Can Benefit From Discovering Your Neck Injury

However, these are actually common symptoms of serious neck injuries. They are already there, but you just haven’t noticed them yet. Now, I don’t mean that you should act all paranoid and visit the doctor every time you feel a slight pain in your neck. But if the pain doesn’t go away after a few days, you shouldn’t just shrug it off and hope it will go away after another few days.

There is another benefit to discovering your neck injury ahead of time. If you can pinpoint the cause of your injury then you could possibly demand compensation for the damage it has caused you. For example, if you got your neck injury from slipping while riding a cruise ship because the floor was wet then it’s the cruise line’s fault.

This means you ask help from a neck injury lawyer and demand compensation from them. If you do not discover your neck injury immediately you increase the chances of it getting worse. By then it will be harder to claim that the injury was caused by someone else when you have also neglected to protect your health as well.

See How Easily You Can Get Compensation For Your Neck Injury

Have you suffered a neck injury that was not your fault? Do you believe that this injury could have been prevented if another person/party had not been negligent? If so, then you should demand compensation from these persons for the medical bills you had to pay and the salary you won’t be getting from work as a result of your injury.

But what happens if they refuse to give you compensation even though you have evidence that proves they had been negligent? When this happens you should contact a neck injury lawyer who can help you earn compensation for what has happened to you. Ideally, lawyers should be experts on the law and be able to make your efforts less of a hassle.

However, you should keep in mind that not all lawyers are equally skilled and reliable. Just because a lawyer offers extremely cheap rates does not mean you should hire him to save on money. And just because he demands really high rates does not mean he is one of the best lawyers in America.

How To Choose The Right Neck Injury Lawyer

The best way to find out whether or not a lawyer is good enough will be to set up a meeting with him and ask important questions. You should find out how long he has been practicing law, specifically law related to personal and neck injuries. Next, you should ask him how many neck injury cases he has handled in the past.

You should also ask him how many of these he has won for his client as opposed to how many he has lost. Do not believe a lawyer who claims he has never lost a case especially if he has handled hundreds of cases. It is just not possible that he has a perfect record. Also, you can judge by the way his office looks and the way he dresses, whether a lawyer seems reliable or not.

When you are seeking compensation for the health and financial problems caused by your neck injury it would be best to consult a neck injury lawyer. But you should make sure this lawyer is qualified to take on your case before you spend your hard earned money on him or her.

Adult Home Owners Faulted for Death of Jean Anderson

Neck injury was the reason for the death of Jean Anderson. She was 75 year old.  Dalton Anderson, the loving husband of Jean, went to the courts and successfully got a second-degree criminal mistreatment case filed against the owners of the adult home she was staying at.

While, the fault does not directly lie on the owners themselves, they are indirectly to blame for what happened because they hoarded money through hiring unqualified people to staff their adult home. In the past, they even hired a 20 year old whose only prior job experience was as a dishwasher in a fastfood restaurant. He was paid only $7 an hour for the caretaker job.

Jean was not taken care of properly during her stay in the adult home. As her health continued to deteriorate, she began falling down more often, sometimes getting bruises or minor injuries in the process. And yet, nobody seemed to notice. Her husband complained that an incompetent caregiver was put in charge of his wife.

When the court questioned the Balagots, the owners of the adult home, they could not prove the competence of their hired staff. Dalton Anderson eventually won the case in court, and was awarded $300,000. Still, no amount of money in the world can ever replace the life of Jean Anderson.

Adult home owners all over America now have reasons to fix the way they run their homes. They are not only dealing with money here, but with lives— the lives of the elderly— as well. Shame on those who continue to hire untrained staff, and purchase cheap medicines and equipment for the use of their patients!

It is bad enough that they are sent to retirement homes, but should they be stripped of their dignity as well? This is one of the rare cases in which a lawsuit over a fatal neck injury was successful. If something similar happens to you or one of your loved ones, don’t hesitate to contact your neck injury lawyer for help.

No Win No Fee for Neck Injuries

Thursday, March 19th, 2009

For many of us, being in a car accident can be a very traumatic experience. With possibilities of having whiplash or more severe neck injury and brain injury, we feel confused, dazed, frightened and just lucky to be alive. Such emotions grip us so intensely that most of us overlook the fact that we have recourse against the one responsible for the accident. The sad thing about this is that though some of us realize that we can file a claim against the perpetrator, most of us never realize it at all.

If you have been a victim of a road accident that happened without any fault on your part, you can file a claim. It doesn’t matter if you’re a driver or a passenger or just a pedestrian who happened to be walking by. As long as you suffered some form of injury because of the accident, you can make a claim for compensation for medical bills spent and even for property lost.

For those who have suffered neck injuries like whiplash, it is best if you hire a neck injury lawyer because he can guide and help you get over the situation. You shouldn’t worry about the cost either, because under the “no win no fee” provision, the claimant doesn’t have to pay anything if he loses the case. Of course, you still have to be sure that the neck injury attorney you hired is a good one, because if you lose, you might have to pay your opponent’s legal fees.

Whiplash, the most common neck injury

Wednesday, March 11th, 2009

One of the most common neck injuries around is Whiplash, so we ask what is Whiplash? The term Whiplash refers to neck injuries that are almost always a result of vehicular accidents. Whiplash is cause by the sudden impact felt by the muscles in and surrounding the head, neck and shoulder area which causes them to distort or go beyond the range of their usual or normal movement. Whiplash usually happens when the head is snapped forward then back again.

Whiplash injury is one of the neck injuries that may be the result of car accidents, and in fact, recent statistic shows that a lot of people made claims for whiplash injury to motor insurance companies. However, Whiplash may also result from sports activities, especially contact sports like boxing, wrestling and taekwondo. This neck injury can also result from a fall from a horse, a bicycle or from just being shaken hard, like the shaken baby syndrome.

The degree of the neck injury depends on the impact on the neck, head or back. Most of the time, Whiplash symptoms are immediately experienced after the accident. However, there are times when the symptoms are delayed so it is always better to immediately visit your doctor after an accident. Whiplash symptoms are neck pains, or pain in the back or shoulders, dizziness, headaches (can be recurring or not), stiffness and fatigue.
